Guest Payment & Cancellation Policy
Applies to every trip sold by TheKITECAT Ltd, including weeks sold with a trip collaborator.
Section 1
Who we are and key terms
"We" or "us" means TheKITECAT Ltd, company number 15773913, registered office 50 North Street, Havant, Hants PO9 1QU, United Kingdom (info@thekitecat.com). "You" means the person named on the booking and each guest it covers. "Trip price" means the price per guest confirmed at booking, including any cabin supplement and add-ons. "Embarkation date" means the first day of your week aboard. All amounts are in euros.
Section 2
Why our terms work this way
We charter our yacht months before the season. From that point the charter company keeps up to 100 % of the charter fee, whether the boat sails full or not. Our payment and cancellation terms follow that commitment, so that each place is paid for by the time we pay for it.
Section 3
Paying for your trip
3.1 Payment schedule
- Deposit at booking: €1,000 per guest. Your place is confirmed when we receive it.
- Second payment, 90 days before embarkation: brings the total paid to 50 % of the trip price.
- Balance, 60 days before embarkation: the remaining 50 %.
You can pay in full at any time. Early-bird and promo-code bookings follow the same schedule, calculated on the price you actually pay.
Example on a €3,500 week — Week 1, embarks 1 March 2027: deposit €1,000 at booking; second payment €750 on 1 December 2026; balance €1,750 on 31 December 2026. Week 2, embarks 8 March 2027: €1,000 at booking; €750 on 8 December 2026; €1,750 on 7 January 2027.
3.2 Late bookings
If you book after a payment date has passed, everything due by that date is payable at booking. Booking 90 to 61 days before embarkation: 50 % of the trip price at booking. Booking 60 days or less before embarkation: the full trip price at booking.
3.3 Late payment
We send a reminder 7 days before each due date. If a payment is still unpaid 7 days after its due date, we may cancel the booking and apply the cancellation fees in section 5.
3.4 Who you pay
All payments go to TheKITECAT Ltd, by card or bank transfer, including bookings made through a trip collaborator or a trip promoter. Bank and currency charges on your side are yours.
Section 4
Changed your mind? 48-hour cooling-off
If you cancel in writing within 48 hours of paying your deposit, we refund everything you paid, provided your embarkation date is more than 60 days away. This does not apply to bookings made 60 days or less before embarkation.
Section 5
If you cancel
5.1 Cancellation fees
Tell us in writing at info@thekitecat.com. The fee depends on the date we receive your notice, counted back from the embarkation date.
- More than 90 days before embarkation: we keep the €1,000 deposit and refund anything paid above the deposit.
- 90 to 61 days before: we keep 50 % of the trip price and refund anything paid above 50 %.
- 60 days or less, or no-show: we keep 100 % of the trip price; nothing is refunded.
We pay refunds within 14 days, to the original payment method.
5.2 Someone takes your place
You can transfer your booking to another person free of charge up to 14 days before embarkation, if they accept these terms and the Trip Agreement, have suitable insurance and fit the cabin arrangement subject to TheKITECAT vetting procedure. If we resell your place ourselves, we refund what you paid minus a €150 admin fee and any discount we had to give to resell it. We never refund more than we recover, and we cannot guarantee a resale.
5.3 Moving to another week
You can move to another week once, free of charge, more than 90 days before your original embarkation date and if a place is free. Your payments move with you and the new week's price and payment dates apply. A later move counts as a cancellation.
5.4 Unused days
We do not refund days you miss, whether you join late, leave early, miss a flight or are removed from the trip under the Trip Agreement for your conduct.
Section 6
If we change or cancel your trip
6.1 We cancel
We may cancel a trip before departure. If the reason is within our control, you choose between a full refund of everything you paid us, within 14 days, and a place on another week or trip of the same value. If the reason is outside our control, section 6.3 applies instead. We tell you as soon as we decide. To the extent the law allows, our liability for a cancellation is limited to the amounts you paid us: we do not pay for flights, other accommodation, visas or any other arrangement you made yourself, so we recommend flexible flights and insurance that covers them.
6.2 Every week runs
We do not cancel a week because it has few bookings. The trip price does not depend on the number of guests on board, and no reduction or refund is due if the yacht is not full. We may sell free places until departure, including through a trip collaborator, and we may change cabin allocations to fit the group, in line with our cabin-sharing rules. We may also offer you a move to another week of the same season; you are free to refuse and travel as booked.
6.3 Events outside anyone's control
Unavoidable and extraordinary circumstances are events that neither you nor we control and whose effects could not have been avoided: a hurricane or named storm, a port or airport closure, a government travel ban or official advice against travel to the destination, epidemic restrictions, war or civil unrest, strikes outside our company, or the charter company withdrawing the yacht.
If such circumstances stop the trip before embarkation, we first offer you new dates or a credit note worth 100 % of what you paid us, valid 24 months and transferable to another person. If you prefer a refund, we refund what you paid us in full within 14 days of your request. No other compensation is due, and we do not pay for flights or other arrangements you made yourself.
If such circumstances cut the trip short or change it after embarkation, we credit the nights lost. We are not liable for additional costs, except where the law requires us to help you.
6.4 Weather, itinerary and the yacht
The skipper decides the route each day for safety and wind. Wind is never guaranteed, and a change of anchorage or a day without kiting does not give a right to a refund. If the charter company replaces our yacht with a similar or larger one, the trip goes ahead as booked. If the yacht is out of service for more than 48 consecutive hours of your week through no fault of yours and no replacement is found, we give you a credit for the nights lost beyond those 48 hours.
Section 7
Travel insurance
Travel insurance is a condition of joining any trip. It must be in place from the date you book and cover, as a minimum: cancellation and curtailment up to the full trip price; emergency medical treatment and hospitalisation (we recommend at least €10 million); search and rescue, evacuation by sea or air, and repatriation; active participation in sailing; kitesurfing, wing foiling and foiling if you plan to ride; and personal liability.
Send us your insurance certificate no later than your balance due date. If you cannot show valid insurance before embarkation, we may refuse boarding; this counts as a cancellation by you under section 5.1 and no refund is due.
Our refunds follow this policy, so a cancellation for illness, a missed flight or a personal reason is claimed from your insurer, not from us. If you travel without adequate cover, you remain responsible for any cost we incur on your behalf, including rescue, evacuation and medical costs.
Section 8
Damage to the yacht
The charter company holds an €8,000 security deposit and the yacht carries an €8,000 insurance excess; the dinghy and outboard are not insured against theft or loss. A guest who damages the yacht or its equipment through carelessness or misconduct pays the cost, as set out in the Trip Agreement.
Section 9
Weeks sold with a trip collaborator
This policy applies to every guest, whoever sold the place. TheKITECAT Ltd remains your contracting party and receives all payments.
Section 10
Your legal rights
This policy is governed by the laws of England and Wales. It does not limit any right you have under the Package Travel and Linked Travel Arrangements Regulations 2018 or other consumer law.
